Ok, I lied when I said Cage's 4'33" would never be a download, as according to Alex Ross, they're adding it to iTunes this week.

To make matters stranger: you can select it as a ring tone.

So if you recorded 4'33", would you owe Cage's estate right's, or could you claim that it was another piece coincedentally named "4'33", but clearly your own work?

Actually, I'm wondering if Cage (or his Estate) sued the record label of the "3 minutes of silence" 45 that was all the rage on jukeboxes starting in 1953...
