He basically asserts that the current system fails to help patients, victims, providers, or insurers, though the lawyers are of course having a field day. However, the system is so broken that merely putting caps on the awards won't solve it.
My only concern is that one study he references goes back to 1991, which may be a bit old to give accurate figures for today, compared to the other studies that cover the period from 1995 to 2000.
