The Dover Decision made it pretty clear that history is next - the canard that America is an expressly Christian country that had been created by evanglists has been floating around for a while. They've gotta do some pretty narrow readings to get that out of the actual writings, but that doesn't stop the kind of guy in your link who just pulls stuff out of his ass.

(BTW, will be posting again on the Dover Decision in a couple of days. There are red flags peppered throughout that show the dominionist game plan... for instance, the reason they're claiming that the judge overreached? They tried to say, in court, that the judge could ONLY rule on the statement, and not even investigate the history of ID or the public statements of belief made by the ID supporters.)

keep reading http://www.pandasthumb.org/ and the personal blogs of its many contributors. the declaration in the judgement that only Jones's court could address the situation is clarified, by lawyers, who will tell you that every lower-level court examining a constitutional argument is practically required to state similar wording: the trial situation is the best means to determine the facts in a case.

the history and nature of ID became fair game when the Discovery Institute contributed its amicus brief. without the brief, the judgement would mostly have to rule on the fact that nobody really can declare what ID really was. the opinion goes into details on how the school board members had no clue, supported by the fact that the disclaimer basically said "go ask your parents" (who would, logically enough, be even more clueless than the schoolboard at this particular question). once the brief was contributed, it became ipso facto the core defining document of ID outside of the Pandas book, and thus was ripe for rippage.

its all there, its all backed up, and even if the former school board were still in power and able/willing to appeal (the current school board that ousted them certainly won't), the opinion would hold up like a ton of bricks.

claims that a supreme court with Roberts and Alito (now there's a pair of total opposites) would rule differently are utter nonsense. Roberts would easily find in the same manner as Jones has, and Alito, Thomas, and Scalia's collective personal biases aren't going to be enough to undo anything.

some of the right are assuming that Roberts is a hard-winger that will find in their collective favor simply because Bush appointed him and he has a (extensive) record of merely following the orders of his boss. what made analyzing his judicial history difficult was how much he simply followed orders -- whatever his boss wanted, he (successfully) argued for. it made it extremely hard to figure out what his own opinions were on anything. (and the right complains about liberal flip-flopping?). how easily they forget that Jones was appointed to his spot by Bush Jr.

its also interesting how those with ambitions assume that everybody is ambitious, and more specifically that Jones has ambitions to be more than a circuit court judge which he now obviously will never reach because of his "activism". this ignores the fact that most judges were and are happy enough simply to have a decent job after law school and a few successful years on the bar-- ambition is not common in the judicial wing of things -- most lawyers become judges because of their modesty (and to a degree, mental exhaustion at having to argue cases; judging seems easier from the outside), not their ambition.

Yes, but they want to have both sides of it - to pull strings from behind the scenes and to pretend that they are a protected, separate, injured entity. (As with the claim that the Dover School Board had nothing to do with Discovery, even after all the testimony that the Boardmembers were going there to get information.)

That, along with the whining that Jones has ruined his career is mostly sour grapes - they expected "their" people to rule "their" way regardless of law or precedent. (After all, the judges are only activists when they interpret laws that annoy folks, as opposed to make crap up and enforce it that the hard right wants to see.)

But at the same time... we call 'em dominionists because they're taking that line about having dominion over the earth waaaaaaaay too seriously. ([livejournal.com profile] dark_christian isn't a bashing community, it's a weather watch for the religion=politics=power crowd)

I have lost track of the number of times I've pointed out the kinds of fallacies cited in that article and corrected them with quotes from "America - Not a Christian Nation" (a web site which I obviously need to look up again and add to the new browser bookmarks ...). I will never, if I live to be 100 years old, understand willful ignorance and dishonesty.
