As much as they would like to think it, "Apple" hasn't been a recognizable trademark for anything Beatles related since the first round of solo albums after the band broke up. When people think of the marketting around the Beatles, they think of Capitol Records (who own the pressing rights) and Michael Jackson (who owns majority share of the publishing rights and is responsible for Beatles music being used in commercials). Nobody thinks of "Apple Core" anymore. Its a useless and diffused Trademark that's lost its value not because it wasn't being actively defended (quite the contrary) but because it simply lost any meaning. Neither living Beatle nor the families of the others, nor Jackson, do any actual work under the Apple Core name. Apple Core has solely been responsible for managing the financial distribution of Beatles music and licensing, and their "logo" is rarely used on either these days except for the CD rereleases of the oriignal albums released under the Apple Core label 35-38 years ago.
As for the logo? Apple Core's logo was two-sided, a solid green apple on one side and a sliced apple on the other. Nothing remotely resembling the Apple Computer logo (whether iPod white or rainbow colored) at all.
This suit never should have been attempted, and for that matter, the original 1991 suit and agreement never should have happened either.

There is nothing to be "protected" as there is not and never has been any threat to the Beatles by anybody using the name "Apple". Nobody has ever called the Beatles' music "Apple" music. Not 28 years ago, and not today.
