WTOP: Teen Sues Restaurant After Drunken Fall:

FREDERICK, Md. (AP) - A teenager who sneaked into a charity bartender contest to drink is suing the restaurant for causing facial injuries she suffered in a drunken fall in the parking lot.

Tyler C. Bauer, 18, of New Market, is seeking $200,000 in damages from TGI Friday's, according to the lawsuit filed March 22 in Frederick County Circuit Court.

Bauer claims the restaurant was negligent in allowing her to consume beer and liquor purchased for her by an 18-year-old companion and an older man on Oct. 11.

The lawsuit says Bauer, then 17, shattered her teeth, lips and gums when she passed out and fell on her face in the parking lot with a blood alcohol level of 0.238 percent - nearly three times the legal limit of 0.08 for operating a motor vehicle. Police reported that Bauer had fallen off the tailgate of a pickup truck while leaving the bar.

The Frederick County Liquor Board fined the restaurant $1,600 in January for allowing Bauer and her underage friend to drink.

Reminds me of that story a few days back about the two teen asshats who broke into an abandoned warehouse property, climbed up to the top and fell in through the skylight. Ignoring no-trespass signs, bypassing fences (think they had to cut one), climbing the restricted property, basically doing B&E. They fall in and get hurt and the parents sue the company for negligence and such.

Um hmm..
Try parenting, folks, not suing.
Instill a little sense of law and decorum into your kids and maybe they won't get hurt being vandals.

What just *slays* me is that people can be utterly and completely irresponsible, then turn around and sue somebody else, trying to make it their fault rather than own their own blame, and *win*!!

Having been an equestrienne for some time, I can tell you a lot of "attractive nuisance" stories. One of my favorites is the woman who was successfully sued because a neighbor kid got into the pasture with the woman's horse (after specifically being told to stay away from the horse) and was injured by said animal. The "attractive nuisance" theory says that you invite trouble by having things like a horse, a swimming pool (or, evidently, a bartending contest) and should be held liable for the stupid shit that people do when messing with your stuff illegally.

My better half was on the jury for a trial where a man was suing an extermination company for being exposed to the poison gas and had suffered neurological damage from it. He was exposed because he broke into a building to rob it while it was being tented for termites.

If someone comes up with a well-thought-out law that essentially says "If you're committing an illegal act, you forfeit your right to sue someone for the consequences of said act" I'll vote for it.

Unfortunately, on a lot of these cases, they get settled and the stupidity just continues...

This is just ONE of the reasons a major part of the current system sucks major balls, hind titty, use whatever euphemism you want...

if justice were to prevail (like having her teeth smashed in wasn't justice enough already), she would get slammed in jail for reckless behaviour and underaged drinking, forced to do community service and/or probation to learn how NOT to be an idiot.

the bar would get fined for serving minors.

no one awarded any money for "damages" they inflicted upon themselves. what a loser.

if "justice were to prevail", the parents would be paying a shitload of money to the taxpayers and to the bar for supporting this rediculous and frivilous lawsuit rather than taking responsibility for their bad parenting (and having the kid take responsibility for her stupidity).
